Civil and Commercial Judicial Assistance
 

General Situation: at present, 13 countries which have concluded treaties about civil and commercial judicial assistance with China include France, Belgium, Italy , Spain, Bulgaria, Hungary, Thailand, Singapore, Korea, Argentina , Morocco, Tunis and United Arab Emirates; 19 countries which have concluded treaties about civil and criminal judicial assistance as well as treaties about civil, commercial and criminal judicial assistance with China include France with China include Poland, Rumania, Russia , Ukraine,White Russia ,Greece, Lithuania, Mongolia, Turkey, Kazakhstan, Cyprus, Kyrgyzstan,Tajikistan, Uzbekistan,Vietnam,Laos, North Korea,Cuba and Egypt. Ministry of Justice was designated as the central authority in most treaties; both Ministry of Justice and the Supreme People's Procuratorate of China were designated as the central authorities in some treaties; both Ministry of Justice and the Supreme Court were designated as the central authorities in some treaties; Ministry of Justice, the Supreme People's Procuratorate of China and the Supreme Court were designated as the central authorities in some treaties. In China's sending legal documents abroad and receiving foreign legal documents, the amount tends to be more and more year-by-year. In 2003, China received 868 requests for assistance in the service of legal documents, and sent 418 requests for assistance in the service of legal documents; received 38 requests in investigation and collection of evidence, sent 12 requests in investigation and collection of evidence. France, America, Japan, Italy and Korea cooperate most closely with China in the field of civil judicial assistance. Details can be seen in appendixes.
